1. Acceptance of Terms

By accessing or using GetProEstimate (the "Site") or submitting a request for contractor services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use this Site.

These Terms constitute a legally binding agreement between you and The Volume Leaders, LLC ("we," "us," or "our"), the operator of GetProEstimate.

2. Description of Service

GetProEstimate is a contractor referral and lead matching service. We connect homeowners and property owners ("Users") with independent, third-party licensed contractors ("Contractors") for home improvement projects in the San Diego area.

We are not a contractor. We do not perform any home improvement work ourselves. We do not employ the contractors in our network. Contractors are independent professionals who are solely responsible for the services they provide.

3. Cost Estimator Tool

By using the estimator tool, you acknowledge that:

• Estimates are based on general market data and your self-reported inputs
• Actual costs from a contractor may be higher or lower than the estimate displayed
• We make no warranty as to the accuracy of any estimate
• An estimate from this tool does not constitute a contractor's bid or commitment to any price

4. SMS Communications

By submitting your phone number on this Site, you expressly consent to receive SMS text messages from The Volume Leaders / GetProEstimate. These messages may include follow-up on your contractor request, appointment scheduling, and service updates.

• Standard message and data rates may apply
• Message frequency varies based on your request and follow-up

5. User Responsibilities

By using this Site and submitting a request, you agree to:

• Provide accurate and complete information about yourself and your project
• Be at least 18 years of age and legally authorized to enter into agreements for home improvement services at the property address provided
• Not submit false, misleading, or fraudulent requests
• Not use the Site for any unlawful purpose or in violation of any applicable law or regulation
• Not attempt to scrape, harvest, or copy data from the Site using automated tools

6. Contractor Relationships

When we match you with a contractor, please understand the following:

• The contractor relationship is directly between you and the contractor. GetProEstimate is not a party to any agreement between you and a contractor.
• We do not guarantee the quality, timeliness, legality, or outcome of any work performed by a contractor.
• While we make reasonable efforts to work with licensed contractors, we do not continuously verify contractor licensing status. You are responsible for independently verifying a contractor's license through the California Contractors State License Board (CSLB) at cslb.ca.gov.
• All contracts, payments, warranties, and disputes regarding home improvement work are between you and the contractor directly.
• We may be paid a referral fee by contractors in our network. This does not affect the quality of the match or create any obligation on your part.

7. No Guarantee of Match

We will make reasonable efforts to connect you with a qualified contractor for your project. However, we do not guarantee that a contractor will be available for your specific project, timeline, or location. Contractor availability varies and is not within our control.

8. Intellectual Property

All content on this Site — including text, graphics, logos, the estimator tool, and its underlying code — is the property of The Volume Leaders, LLC and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our express written permission.

9. Disclaimer of Warranties

THIS SITE AND ITS SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE VOLUME LEADERS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Your use of or inability to use this Site
• Any home improvement work performed or not performed by a contractor
• Any inaccuracy in cost estimates provided by the estimator tool
• Any unauthorized access to or alteration of your information

In no event shall our total liability to you exceed $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Volume Leaders, LLC, its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of this Site, your violation of these Terms, or your interactions with any contractor.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.

Before initiating any legal action, you agree to contact us at dhiggins361@gmail.com and attempt to resolve the dispute informally for at least 30 days.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of the Site after any modification constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
